PointsBet Faces CA$150,000 Fine from AGCO Over Responsible Gambling Failures

In the realm of Ontario's burgeoning online gambling sector, PointsBet Canada has found itself in hot water with the Alcohol and Gaming Commission of Ontario (AGCO). The regulatory body, overseeing iGaming activities, has imposed a substantial fine of CA$150,000 on PointsBet Canada for non-compliance with the province's responsible gambling standards.

The AGCO, managing various sectors, including gaming, alcohol, horse racing, and private cannabis retail, has a pivotal role in supervising Ontario's competitive market for online gambling and sports betting. The penalty comes as a consequence of PointsBet Canada's failure to adhere to the responsible gambling provisions outlined in the Registrar’s Standards for Internet Gaming.

The crux of the matter involves PointsBet Canada's inadequate intervention to assist a player facing gambling issues. This user incurred losses exceeding CA$500,000 within a span of three months, prompting concerns about responsible gambling practices. Despite the player being flagged as potentially high-risk due to significant losses and repeated withdrawal cancellations, the operator failed to implement necessary interventions.

Furthermore, PointsBet Canada neglected to enforce a mandatory 24-hour cooling-off period when the player canceled their per-day deposit limit. The company also violated regulations by sending gambling inducements, bonuses, or credits through direct advertising without obtaining the player’s consent. Even after the player unsubscribed from direct advertising, credits totaling CA$35,500 were repeatedly deposited into their account. Additionally, the operator extended numerous offers of free tickets to sporting events.

This is not the first time PointsBet Canada has faced the ire of the AGCO. In April 2022, just weeks after the launch of Ontario's online gambling market, the operator was fined for breaching Standard 2.05. The violation occurred when PointsBet Canada displayed posters in GO stations and on GO trains featuring inducements to play for free. The company expressed regret for misinterpreting the rules at the time.

Dr. Karin Schnarr, Chief Executive Officer and Registrar at AGCO, emphasized that iGaming operators are obligated to proactively monitor users for signs of high-risk gambling. The AGCO will continue to prioritize player protection, holding all licensed operators to elevated standards.

PointsBet Canada joins Unibet as another recipient of AGCO fines in Ontario's iCasino and sports betting sector. Unibet faced a CA$48,000 penalty for advertising generous welcome offers, contravening the province's current prohibition on operators advertising bonuses, credits, or sign-up incentives. As the market evolves, AGCO remains vigilant in enforcing regulations to safeguard the interests of players.
